Any personal data we obtain in the course of our interactions with you as a visitor to our website, as a customer, as a supplier, as a debtor or as a job applicant will be collected and processed in accordance with applicable data protection legislation, in particular the General Data Protection Regulation 2016/679 of 27 April 2016 (‘GDPR’).

In this Privacy Statement, we explain what information we collect about you, what that information is used for and to whom the information is disclosed. It also tells you what rights you have and how you can exercise them.

If you fail to provide us with any necessary personal data, you may not be able to use our services.

This Statement may be amended from time to time (see point 11).

2. Purpose of processing

C.M.A. processes your personal data according to the reason for your contact.

Debt collection
We process personal data and contact details of debtors, their relatives and any representatives or contacts that are relevant and necessary for the performance of our business, being the collection of outstanding debts on behalf of our customers. These data are used, among other things, to contact the debtor concerned (by post, email, text message or telephone) for the purpose of recovering the outstanding debt. This processing is necessary for the performance of the agreement between C.M.A. and our clients and is based on our legitimate interest, namely the recovery of the outstanding debt of the debtor concerned.

Portal
A portal is available on our website for clients and for debtors, where they can log in to access their file data. In this context, we process personal data, contact details, financial flows and correspondence between you and C.M.A. This processing is necessary for the proper performance of the agreement between C.M.A. and our clients and is based on our legitimate interest, namely obtaining the outstanding debt of the debtor concerned.

Customer management
In the context of our customer management, we process customers’ personal data. More specifically, this involves processing the personal data for the purpose of drawing up and managing contracts, creating a customer file in our Teamleader CRM package and invoice administration. This processing is necessary for the execution of the agreement between you and C.M.A.

Supplier management
We process the personal data and contact details of our suppliers and supplier contacts. More specifically, this involves processing in the context of managing supplier administration, invoice administration and payment of invoices. Such processing is necessary for the performance of the agreement between you and C.M.A.

Recruitment
If you provide certain personal data as part of an application to C.M.A., these data will be collected and processed to handle the further recruitment process. If the recruitment is done through an external recruitment agency, this processing is based on our legitimate interest, namely finding a suitable candidate for the position. Similarly, if you apply directly to C.M.A., this processing is based on our legitimate interest, namely finding a suitable candidate for the position. This interest is always weighed against your interests as an applicant.

Compliance obligations
To meet our legal obligations, certain personal data are processed of our board members, shareholders and also any legal representatives or proxy holders. This processing is based on our legal obligations.

Sales & Marketing
When you act as a contact for one of our customers or prospects, we keep your contact details so that we can contact you directly. This includes your name and email address. This processing is part of our legitimate interest, namely to inform our customers and prospects about our products and activities.

If you receive our newsletter, you can unsubscribe from it at any time using the unsubscribe link at the bottom of each email.

Website contact form
When you contact us through the contact form on our website, we process your personal contact data in order to manage and answer your queries. In this case, the processing of your personal data is based on our legitimate interest, namely fulfilling your request after you contact us.

3. Categories of personal data

Depending on the purposes as described above, we process the following personal data:

Personal identification data (name, address, national register number, signature, identity card number, photo, phone number, email, bank account number, VAT number, signature, social security identification number)
Personal characteristics (date of birth, place of birth, place of residence, housing characteristics, nationality, marital status, identity of partner, matrimonial property regime, identity of family members/cohabitants, identity of descendants, employment)
Financial details (debts, expenses, solvency, loans, mortgages, credits, pension data)
Financial data (bank account number)

4. Recipients of your personal data

Your personal data may be provided to third parties if necessary for the fulfilment of the above-mentioned purposes. Your data will otherwise only be processed internally, unless it is legally required or permitted to share your data with third parties.

If we use an external selection agency to select a suitable candidate, the personal data collected during the recruitment process are also shared with the selection agency.

Your data may also be stored with third parties. This involves software applications we use. In such cases, the data are technically protected as much as possible against unauthorised access (e.g. by encrypting the data). Moreover, these parties are always bound by a confidentiality obligation.

Wherever possible, we use specialised and secure platforms to exchange your personal data.

5. Retention period

C.M.A. keeps your personal data for as long as necessary for the purposes stated above or to comply with a legal obligation incumbent upon it.

6. Transfer outside the EU/EEA

In principle, your personal data will not be transferred outside the European Economic Area.

7. Automated decision-making

C.M.A. does not base decisions on automated decision-making, including profiling.

8. Security measures

C.M.A. undertakes to the best of its ability to take all reasonable measures to ensure the protection of your personal data to protect them from misuse, loss and unauthorised access. These measures are always based on the current state of the art.

9. What are your rights?

You have various rights regarding the personal data we process about you.
You can exercise these rights by contacting us using the contact details set out in point 10.

As part of our identification obligation, we may ask you to provide us with a copy of your identity card.

1. Right of inspection and correction
If you want to know what personal data C.M.A. processes about you and for what purposes, you can contact us. You may also request that any erroneous personal data be corrected or that your data be amended.

2. Right to removal and restriction
You have the right to ask us to delete your personal data. Certain data may be retained by C.M.A. after your deletion request, for example because we have a legal obligation to keep the data for a certain period of time.
If you have legitimate reasons to do so, you may ask us to restrict the processing of your personal data, for example, because you dispute the accuracy of your data.

3. Right of objection
If the processing of your personal data is based on our legitimate interest or takes place within the framework of fulfilling a task of public interest or public authority, you can object to the processing of your personal data in a reasoned manner.

4. Right to data portability
If we process your personal data on the basis of your (explicit) consent or in the context of the performance of the agreement between you and us, you may request that we provide you with the personal data you have provided to us in a structured, common and machine-readable form or transfer it to another controller, provided that the processing is carried out through automated processes.

5. Right to withdraw your consent
Where the processing of your personal data by C.M.A. is based on your (explicit) consent, you have the right to withdraw this consent again at any time. However, the withdrawal of your consent does not affect the lawfulness of the processing prior to the withdrawal of your consent.

6. Right to complain
You have the right to complain to the Data Protection Authority if you have a complaint about C.M.A.’s use of your personal data.

Use of ‘cookies’.
